Do not pass this bill. The dog hunters in the surrounding counties already take advantage of road shoulders to hunt from and drop off their dogs. This bill encourages this practice further promotes this unsafe activity. We have problems with dogs running in the road and getting struck. Dogs have run deer into our family car and caused us to loose use of our vehicle. Hunters block the roads and road shoulders and lastly while they are not supposed to they do shoot across the roadway at deer while hunting.

Our hunt's volunteer staff often need to be at an edge of the roadway in a parked "hound truck" to block hounds from running into other territories, other land owner's property, and/or to keep them from running across a major roadway. The staff and truck also need to be able to be there, God forbid in case of a medical emergency or injury to hound, horse or rider. I support this bill! I am a hunter that uses dogs, I am a pet owner and I am a member of a community that is rural, where pets and livestock get in the road at times. I want to be able to keep my animals from getting killed in the road and help others who may have a pet, hunting companion or livestock that has possibly gotten in a road. I want to be able to help without worrying that I may receive a ticket. As hunters that use dogs, the majority of us spend thousands of dollars to monitor the locations of our dogs so that they will not get killed in a road. We want to be able to stop and gather our animals safely. Many times I have stopped in a road to get another persons pet or a farmers goats, cows or horses out of a road. I have read in the comments that others have accused hunters of using the road way to hunt from. Some of these accusations are based on the fact that there is a gun in the truck and that it might be loaded. That accusation is just like saying that if I buy beer and put it in my vehicle then I am going to drink and drive. I know that this is not true in most situations, just as having a gun in my vehicle and stopping to catch my dog is not hunting from a road. Most hunters just want to save there hunting companion from being hit by a vehicle. Thank you for your time.

HB 2146, I fully support this bill and what safety it provides to not only hunters, drivers, tourist to our great state of Virginia, but the fact is it will give all of us an opportunity to protect our companions, our pets. We can help prevent the lost pet or the stray animals from being injured. There is a lot of opposition to this bill just like any other. Mostly because it aids in helping in some peoples minds hunters more than the owner of a pet that goes missing that is beside a major roadway or back road that they are trying to protect from being injured. Conservation officers in the past have preyed on hunters trying to retrieve their hounds on public land which were out of the roadway and were only trying to prevent harm not cause any. They were not preventing traffic to continue in the direction of travel only asking they slow down as they are trying to prevent any injury the hounds and the passerby vehicles. To which motorist had no issues, Its no different than a motorist on the shoulder of the road with a vehicle issue (flat tire, engine trouble, etc). We as motorist see that all the time and we have seen hunters trying to retrieve their hunting partners just as well out of the roadway. Hound hunting is dated back to the days of George Washington. It is a sport that many individuals take pride in and love. I've never once heard a hunter say man I cant believe those people are gonna sit in all that traffic for hours just to go to a football game????? Or man sure seems farfetched to just be heading up to the mountains for 2 days to go skiing... We all as Americans enjoy different activities, hobbies sports, etc. and that's been a right that was given to us by our ancestors. That's what makes our Country so unique our diversity. Yes true to any sport there can be bad apples and no one is going to disagree with that. But when you provide anyone with the safety, the correct laws, add that to the pride and passion that hunters hold no matter what way of life they come from. Your end result will always continue to be moving forward not going backwards. We can use these laws to better the relationships with hunters and conservation officers, landowners, general public. The list could go on and on. I take pride and compassion in supporting a sport I grew up loving and continue to love today as I teach my children about hunting and laws and doing things the right way. We continue each day to agree and to disagree but at the end of the day we support the basics of life and continue to respect each other, and move forward as better people today than we were yesterday. It seems self evident to me that a person seeking to recover a companion animal either from the roadway or adjacent area can park on the adjacent unoccupied right of way for that purpose. A stopped vehicle, with flashers and reflectors, is much more likely to be seen by other motorists, and alert them that something is wrong up ahead. A companion animal jumping into the road will not be seen until the last minute, and can cause a terrible accident as the drivers seek to avoid the animal. In this way the stopped vehicle provides a safe alternative to removing the animal from the roadway, and prevent severe accidents.

Our property values have been destroyed by dog hunters, and you can't even try to sell a piece of land in this area unless you wait until hunting season is over. It's truly disgusting and everyone is sick of it. If it's money that motivates this board, then name your price. Our families who want to drive on the road without being shot in the head, will pay the price. We have all been talking about becoming more active in politics, just like the dog hunters do. They bring people from all over the state and outside of the state to hunt on our lands and roads. They run clubs that take in thousands of dollars to join, pay thousands of dollars to out of town landowners, and don't pay one dime in taxes or write one 1099 to a landowner. It is the biggest organized crime spree to ever take advantage of the IRS and the State of Virginia revenue dept. They use public roads and private land to get rich off of, and never pay a dam dime in taxes. Don't let anyone fool you. Look at the Game dept handbook and they brag about all of the revenue generated by dog hunter and clubs. They make so much they are able to pay for this bill and other legislation that take the rights of citizens from us all. Ask them to pay taxes, register as charitable or taxable entities like all others who run a business, and then we can talk about giving them our highways. This bill is a damn joke!

This bill, as offered by Delegate Miyares, is deliberately misleading. I',m just "Catching my dog", are the first words out of any hound hunter who is illegally hunting on Virginia's roadsides. The hunters who park on the roadside to protect, catch, or corral their dogs, have loaded shotguns on the front seat, ready to shoot. They also employ sophisticated methods of warning each other when law enforcement or Conservation Police Officers are in the locale. Citizen band radios, walkie talkies, and cell phones, all are employed to warn caravans of 20-30 trucks as to when it is safe to shoot across the highway, or when they should place their weapon back on the front seat before a police officer approaches. In most counties, hunters are free to stand in the roadways and right of ways with loaded weapons. It only becomes illegal, when the weapon is discharged. Landowners are under the impression that this bill was submitted by a delegate who takes PAC money from the dog hunting clubs, and has submitted this bill to legalize the sport of road hunting. Citizens are concerned the intent of this bill, is to make the policing of criminal activity more difficult for the police officers, and protect the unlawful hunting in the road which is so crucial to the success of hound hunting. Before voting on this bill, please contact local Conservation Officers, and ask them how the roadside hunting game is played! If hunters are concerned for the safety of their hounds, you should ask why they release dogs on the roadside, or why they choose to hunt so closely to busy roads and highways. Why not hunt on large parcels, away from roads. Problems with this bill include: This bill does not limit the number of vehicles that can be assigned to "catch" roaming hounds. May twenty, thirty, or a hundred vehicles be used to "catch" a hound? This bill does not require that guns are absent, before using the vehicle for the purpose of "catching" a hound. This bill does not stop someone from having a loaded gun in his hand while catching his hound on foot. ( Hunters standing in the roadside with a loaded gun, are usually the people who shoot moving deer in front of the hounds.) This bill does not require the hunter to have permission of the landowner, before carrying weapons in front of their homes and property, while in their vehicle or on foot. This bill allows "selective enforcement" of VDOT regulations, with regard to "Organized events on Virginia's roadways. It places Hound Hunters in a elevated status over other groups, and civic organizations. Before voting on this bill, realize that electronic collars are readily available to track (with GPS), and deter hounds from crossing roadways. Hunters know this, and the general public does as well. To pretend that this is an emergency care bill for hounds, is a joke. Dear Committee Members, I have been a fox chasing Whipper In for decades. I have been a Road Whip, for a large number of those years. My sole responsibility, is to attempt to intercept and to prevent, our foxhounds from crossing dangerous roads in their pursuit of game. And, to consequently prevent them from either getting killed on the road ways, or creating an accident or incident in an encounter with a motorist. I carry state of the art GPS technology with me, so that I can track the path that my hounds are taking, and get in a position and place to attempt to intercept them safely. When I find myself on roadways of any kind or size, I always run with headlights and flashers, so that I am extremely visible to any other traffic. I always, pull off as far as the shoulder or field will allow, so as to not impede traffic, but also to allow me to have room to gather our hounds, and load them safely into our hound transport truck. We have two people on duty in our truck, so that when we need to stop and gather hounds, we can do it as quickly , efficiently and safely as possible. Since our hunt country roads, seemed to be used more and more by people cutting thru our environment in route to other localities, I have noticed a dramatic upswing of frightening encounters with motorists! In the past, people always seemed helpful. They would slow down or wait, put their flashers on to help alert others, stop and offer assistance, or at the very least, give us a wide and slow margin when passing. In the past three years alone, the behavior I have been subjected too, has become increasingly menacing, threatening and aggressive! I have been verbally abused, and verbally threatened. I’ve had people speed up, and people swerve towards me and our hounds. I’ve had people lean on their horns , seemingly trying to scatter our gathered pack , while we are in the process of loading them in our truck. The speeds which with these types of individuals blow by me, is most often not anywhere near what is the posted limit. What appears to be premeditated and intentional acts, of endangering us on the roadways with motorized vehicles, is no longer the isolated incident, but the everyday norm. I would personally appreciate any form of protection that you might afford, to those of us that are trying to make a safe retrieval of our animals. Not only for their sakes, but for anyone else on the roadways. Thank you!

This bill will essentially allow hound hunters to line up along state roads to hunt (retrieving hounds is an extension of the hunt). This bill focuses on protecting hounds running at large instead of protecting passengers in autos driving on state roads. This bill places a higher value of a hound's life above the value of passengers lives. Hounds in the road is not an emergency if the hunter creates the emergency by allowing their hounds to run at large. The irony is that this bill actually creates a real emergency to drivers on state roads. Who's lives are more important? A hound or a person? This bill does not address the issue. Apply some problem solving and identify the issue. The issue is not the drivers driving along a state road, so why are you considering a bill that address the drivers as the issue? Hunters currently stand in the road to block traffic so their hounds can cross the road to continue the chase. This is the problem and presents a hazzard to both the hunter and the drivers. Hunters are not law enforcement or EMS and should not be allowed to stop traffic on a state road. Identify the real problem and solve the real problem.

Currently, deer/dog hunters turn dogs loose on "postage stamp" size lots, and run their dogs across properties they do not have permission to hunt on. Once the dogs cross private property, caravans of twenty to thirty trucks, blast deer on and in the roadsides of public highways. Six years ago, an off duty Essex County deputy shot another deputy in the head with buck shot while hunting on the roadside. What kind of a Moron would even consider passing this bill? There are a limited number of conservation officers, and there is no possibility of policing road side shootouts. VDOT requires school marching bands, civic groups and any other number of public entities to apply for permits to hold "organized events" on the highways of Virginia. None of these events have the potential for the loss of innocent life, like the spreading of 30 or more hunters with shotguns along the roadside, waiting for passing deer. The pathetic excuse of saving the life of their dogs can easily be debunked. If you really care about your dogs, control them, train them, or keep them safely away from highways before turning them loose. In most Virginia counties, you can stand in the roadways with a loaded hunting weapon, and there is no criminal violation. Children as young as 12 years of age to hunt on the roadsides with their companions. No age limit to hunt on the roadside, no permit required. If the same children picked up musical instruments with their school band and tried to march on the roadside, they would be given a fine, and required to appear in Court. We require parents to lock firearms away from children in the home, but allow the same children to wield dangerous weapons on the roadside. If passed, this asinine bill will make all members of the Virginia General Assembly, the laughing stock of the entire United States.

I have been a police officer for 21 years and I am also cycling coach for Peaks Coaching Group, based out of Bedford, VA. On October 19, 2008 I was struck from behind by an elderly motorist in Madison County, VA. I suffered some very serious injuries because of this incident; including breaking several lumbar vertebrae (L3, L4, and L5), several ribs, nerve damage in my left leg, and a TBI (concussion) that left me with no memory of the moments before the impact, the collision itself, or several minutes after it occurred. According to witnesses, I had stopped breathing momentarily before I started to make a wheezing, gurgling, raspy noise that sounded like I was trying to breathe. As someone who's been a police officer for 21 years, I've watched many people die in front of me over my career. That breathing "noise" the witnesses described sounds like the "death rattle", a sound that people make when they are struggling to breathe and near death. Luckily I am still here, and I am still able to continue to work, although I am plagued by constant low back pain on a daily basis. After the crash, I was out of work completely for 5 months and on strict bed rest. Then I was required to work in a light duty capacity (desk bound, in a shirt and tie) for another 7 months. I returned to full-duty 51 weeks after I was struck while riding my bike, but, admittedly, I returned too soon. I should have spent at least another 6 months rehabbing my injuries. Today, I still suffer from chronic low back pain which makes doing my job challenging most days, and almost impossible to do on the worst days. I've become very good at dealing with pain and just living with it. I also have numerous lingering issues from the TBI, which include: memory problems, insomnia, occasional vertigo, aphasia, migraine headaches, tinnitus, and lots of trouble focusing and paying attention. My neurologist prescribed a 3-Tesla Neuroquant MRI to be done on my brain in October 2011. It found rather significant atrophy of my right hemisphere, atrophy in at least one hippocampus (where short term memory is converted to long term memory), and there were numerous white spots all throughout my brain. My neurologist stated that he had never seen anyone with those white spots that did not have Alzheimer's, Parkinson's, or dementia. Now for the good news! I have found that regular exercise helps mitigate my concussion symptoms. Many of them have improved quite a bit since I started riding my bike again in 2012. The biggest issues that remain are the memory and attention problems, as well as regular migraines. But all of those have improved. The back pain will always be an issue though. I was one of the 700-850 that is injured on a Virginia road annually. Sometimes I feel like too much attention is paid to the 12-15 cyclists that lose their lives. But what about the people like me that have to live with a lifetime of injuries and pain due to the careless, reckless, or impatient actions of a motorist that doesn't want to give cyclists enough room when passing? I still get fearful before going for a bike ride, even though it's been over 12 years since I was struck. HB 2146, Parked cars in VDOT right-of-ways appears to be a common sense, innocuous bill designed for the public to be able to stop on a VDOT right-of-way and save a cat or dog in danger of being hit by a vehicle. Unfortunately, I must point out the background and real purpose and impact of the legislation. Of course, the general public are not receiving tickets for saving an animal in danger, but who are receiving a few tickets based on current Virginia Code are deer dog hunting clubs hunting on highway road shoulders. HB 2146 is designed to make it legal for these clubs to park on the VDOT road shoulders waiting for the deer dogs to run deer to these roads so they may shoot them. The danger this common practice of lining public roads with hunters waiting for the hounds to run the deer to them is already extreme. Drivers going 60 mph suddenly come upon parked vehicles, hunters with weapons spread along the road, not to mention the deer and dogs that end up in the travel lanes. The bills sponsor, Delegate Miyares, received a $2000 contribution from the deer dog hunting lobby this past November. The deer dog lobby supports this dangerous bill. I have attacked a video taken December 30, 2020 in Essex County showing deer dog hunters using the right-of-way to hunt, a very common and illegal practice under current Code.
