The bill changes current policy and directs the SCC to permit reimbursement of "reasonable and prudent" utility expenditures on SMR development. In practice, utility lawyers and experts are very persuasive. Does the SCC have the staff or outside resources to fully evaluate the information the utilities provide about “advanced” reactor design and engineering? Implementing HB1491, sunk costs from front-end government subsidized capital and relatively low, early ratepayer costs will help APCo attorneys and engineers convince the SCC to require ratepayers to continue reimbursing ongoing SMR expenses incrementally. Continuing to require ratepayer credit for SMRs becomes the default choice. Throwing good money after bad. Utilities win either way by scooping up front-end federal and state subsidies, then forcing ratepayers to reimburse all other expenses. Like the $600 million “recovered” from Virginians for the shelved North Anna #3, designed but never built as this bill would allow APCo to force ratepayers to take the risks and pay even if a SMR nuclear plant is never completed. Then to be able to request a profit on top of the ratepayer subsidies, as if the plant were already producing electricity. The proposed SMRs are far from small. SB454 permits multiple SMRs, each up to 500 MW, at a single location. 500 MW is a standard-sized reactor, according to the Department of Energy. At the 500 mW limit a “small” modular nuclear reactor would be more than half as big as the largest nuclear reactors currently operating in Virginia. In a number of ways, this is no small thing. Please spare Virginia’s APCo customers - residential, commercial and industrial - from being forced to bear the risk and burden for SMRs. The risk for a risky project rightly falls on the company and its stockholders. Vote ”NO” on HB-1491.

HB 745 (Laufer) This legislation would establish a mattress stewardship program to network of convenient and free collection sites for post-consumer mattresses, defined in the bill, that will facilitate higher rates of recycling and materials recovery for post-consumer mattresses. Reasons to SUPPORT HB745: Product stewardship programs are one of the best tools to reduce litter and increase recycling. Product stewardship puts responsibility on producers to develop recycling systems for their products. Mattresses contain high-value recyclable materials that can be recovered and used to create new products. According to the Mattress Recycling Council, more than 50,000 mattresses are discarded in the U.S. each day and more than 75 percent of a mattress can be recycled. HB 968 (Lopez) This Legislation Would: Create the Virginia Climate Innovation Authority to finance clean energy projects, greenhouse gas emissions reduction projects, and other qualified projects through the strategic deployment of public funds in the form of grants, loans, credit enhancements, and other financing mechanisms. Reasons to SUPPORT HB 968: Creation of the Virginia Climate Innovation Authority would: Accelerate the adoption of proven clean energy technology and greenhouse gas reduction projects to expand access to untapped markets and to bring benefits to historically underserved communities. Catalyze access to federal funds included in the Inflation Reduction Act, such as the Greenhouse Gas Reduction Fund (GGRF), a $27 billion commitment to fund “green banks” and other investment vehicles. Use public dollars to leverage private investment. HB 985 (Tran) High polycyclic aromatic hydrocarbon; prohibits pavement sealants that contain, civil penalty. This legislation would: Prohibit the use of toxic high-PAH pavement sealants. Reasons to SUPPORT HB985: The Chesapeake Bay Program has prioritized polycyclic aromatic hydrocarbons (PAHs) as the second most important toxic contaminant. PAHs are a class of chemicals that are the byproduct left over from burning coal, oil, gas, or wood. Statement of the Virginia Association of Soil and Water Conservation Districts in Support of HB 199 The Virginia Association of Soil and Water Conservation Districts (VASWCD) is a private nonprofit association of 47 soil and water conservation districts in Virginia. The Association provides and promotes leadership in the conservation of natural resources through stewardship and education programs. It coordinates conservation efforts statewide to focus effectively on issues identified by local member districts. Our mission is to serve and strengthen soil and water conservation districts in the stewardship of natural resources. At our December 2022 annual meeting, the Association unanimously expressed support for the General Assembly to remove any incentives to convert forest and prime agricultural lands into solar facilities, but instead to provide incentives for such solar facilities to be developed on brownfields and on existing residential and commercial structures, where they can contribute to greenhouse gas emission reduction without impairing the environmental quality in the Commonwealth or hurting our invaluable agricultural economy and way of life in rural Virginia. The Virginia Brownfield and Coal Mine Renewable Energy and Grant Fund Program was established in 2021, patroned by Delegate Kilgore. However, under current law it can only be funded through federal funds, which have never been forthcoming. Old coal mines and brownfields in Virginia could be very helpful in both meeting our Commonwealth’s renewable energy goals and in revitalizing our communities. HB 199 addresses the failure of the federal government to support this worthwhile program by making it possible for it to be funded with state government funds. The Virginia Association of Soil and Water Conservation Districts therefore strongly supports HB 199 patroned by Delegate Krizek. We believe HB 199 takes a positive step to promote responsible renewable energy development and, in the process, bring brownfields and old coal mines back to contributing economic and environmental value to Virginia communities. That is why ACC and our Plastics Division members were among the first to establish ambitious, forward-thinking goals that all plastic packaging in the United States is reused, recycled, or recovered by 2040 and that all U.S. plastic packaging is recyclable or recoverable by 2030. Achieving these goals will require industry, manufacturers, brands and retailers, recyclers, and waste haulers, as well as citizens, communities, non-profits, academics, and federal, state, and local governments, to come together to support policies and programs to increase the supply of and demand for recycled materials and create the circular economy we all want. Under this legislation, the Center would focus on increasing end markets for recycled content through applied research and development, marketing, and policy analysis. The Center would be the Commonwealth’s focal point for producers, recovery facilities, packaging manufacturers, retailers, local governments, environmental organizations, higher education, and in-state agencies. This proposal acknowledges that recycling is not just an activity designed to improve the environment, but also a part of the economic system. The Center’s activities aim to enhance the supply of material so that it is of sufficient quality and quantity to be of value to end markets and increase the demand for the material and goods made from recycled content. These important features of the Center will help Virginia transition from a linear economy to a circular economy. Again, ACC urges the committee to support this legislation. Therefore, I've been researching the issue and it is apparent that lack of markets is a big factor in the rising cost of curbside recycling. Please create the Virginia Recycling Development Center and the Recycling Market Development Fund so we can move forward on the Governor's Executive Order #17. Friends of Accotink Creek supports HB 320. Allowing volunteers apply best practices for controlling invasive vines (painting herbicide on freshly cut stumps/roots) will allow them to do the job properly. Just cutting the vines is a waste of time. Uprooting vines on a regular basis risks serious back injury to volunteers. Some infestations like lesser celandine and ailanthus trees can ONLY be controlled by herbicides. Virginia hasn't the funds to pay herbicide crews to treat all its invasive-infested areas. The slack will have to picked up by volunteers.

HB47 Please support this bill. Invasive plants should not be available for sale in Virginia nurseries. Our state government has estimated that invasive plants are costing Virginia's economy upwards of $1 billion per year. I walk around our neighborhood clipping English Ivy off of trees as these invasive vines slowly kill trees. Much of the general public, landscapers and nurseries are ignorant about the cost of invasive plants. They spread and over take our landscape destroying habitat and food for our birds, pollinators and other wildlife. HB320 Please support this bill which would allow the many volunteers that are tackling the invasives problem to do an effective job in eliminating them once and for all by using herbicides. HB316 Please support this bill so we can move to a circular economy. We need a recycling vision and facilities so that Virginians can keep plastic out of the ocean, re-use glass, paper and aluminum. Business opportunities exist at the local levels. Food waste and compostable packaging need a digester. Plastics can be recycled into toys and other consumer products. There should be no single use products that pollute our land and our oceans. Without commitment this won't happen. HB245 Please support this bill and let's see what chemical companies are dumping into our environment. PFAs are dangerous and are accumulating in all of our bodies. They are everywhere. We need to stop and protect ourselves and our children. The toxic chemicals surround us and we allow the chemical companies to dupe us into thinking that they are safe.

I support HB316 because recycling will only be effective if there is a profitable use for the materials collected. Fairfax County has developed a use for glass, which would otherwise not be cost-effective to collect. The Virginia TREX factory uses recycled plastic to make its product, thus encouraging recycling plastic bags and bottles. These examples show that recycling can be cost-effective. The current low price of natural gas - the source material for plastic - has made recycling plastic unprofitable. More local uses for recyclable materials that do not involve large shipping costs will help balance those costs. Virginia should lead in removing recyclable waste from the environment by developing more new local cost-effective uses.

I live adjacent to land, separated by a homeowners easement, belonging to Leesylvania State Park, where this request for temporary easement is proposed. Approximately nine years ago, I personally benefited from a slope failure restoration that utilized a temporary road in the same location as this proposal. The availability of this temporary road allowed heavy trucks and earthmoving equipment to enter the failed slope area without directly disturbing the homes associated with the failure. I am very grateful that the slope restoration saved not only my home, but several others in the immediate area. I am intimately familiar with how the land temporarily used as a road, then, is nearly undistinguishable from the remainder of the forest, today. I feel that the land will heel, and no long-term adverse results will occur. I am also aware that a storm drain easement has been proposed to access the failed slope area. That storm drain easement is next to my home and I surmise that heavy equipment using this area would immediately result in catastrophic damage to my property and most likely to the structural integrity of my foundation and home. I strongly oppose this easement for access to the failed slope area, as would my neighbor on the other side of the easement. I implore that you authorize use of this temporary road through a very small portion of Leesylvania State Park so that my neighbors two houses away can save their property as mine was saved nine years ago. This bill provides a vitally needed easement through an unused part of Leesylvania State Park to allow the Newport Estates HOA to perform necessary soil erosion remediation behind and beginning to encroach on the property (and then the homes) of several residents in the community. If the easement is not approved, heavy construction equipment (400 dump trucks) will need to travel on community streets not designed for this equipment and, more significantly, travel between and then behind homes in the community to access the soil erosion remediation area. That traffic could threaten the soil stability and potentially the foundational stability surrounding those homes and could cause a slope failure. That area experienced a slope failure many years ago in an area near the current soil remediation location. The easement will allow easy access along the boundary line of the State Park, in an area without any roads, trails or use of the State Park. The aesthetics of the State Park will also not be negatively impacted. Note that the community used the same access sought by this easement years ago in connection with a slope failure in a different part of the same area. No lasting or negative impacts on the State Park occurred. After the easement area is no longer needed, the natural fauna will again reclaim that area as it did before. I implore you to approve this bill. This is a non-partisan, practical bill that does not waste financial or other precious resources. Please support it. Please vote to grant and allow a temporary construction of an ingress and egress easement over Neabsco Road at Leesylvania State Park. The alternative will require the removal of approximately 4,000 cubic yards (400 dump trucks full) of soil from the area using the main thoroughfares within our neighborhood. My kids, along with many others in the neighborhood, enjoying playing together in the areas where these vehicles and construction equipment will be traveling back and forth. The use of that much construction equipment and trucks throughout the neighborhood also pose a safety risk to personal property and individuals. Living right next to Leesylvania State Park, I am a huge advocate for Virginia's parks and recreational areas. But when comparing the risk to individuals and personal property within the neighborhood, I strongly believe the right thing to do is create a temporary easement from Neabsco Rd. This easement will allow for trucks and equipment to safely traverse to and from the affected area, while minimizing risk to individuals and property. My name is Rogard Ross, President of the Friends of Indian River, a local community group in Chesapeake. On behalf of our group and the residents of the Indian River community in Chesapeake, I ask you to support HB999 to prohibit hunting on our urban waterway. Our community has been thoroughly urbanized for over 60 years and is in the City of Chesapeake's Urban Overlay. Approximately 25,000 people live in this 5 square mile watershed. Along the just over 4 miles of waterfront in the community for which we are requesting a hunting prohibition we have over 500 single family homes, primarily on small lots, 2 apartment complexes, 1 townhouse community, 1 community park with another under construction, and on the south end of the waterway, 3 public schools and a community center. These communities were mostly built out in the 1950's and 1960's. There has been no tradition of hunting on the Indian River for at least three generations. The State law enables that “any municipal corporation may by ordinance prohibit all hunting with firearms or other weapons in… area … in the opinion of the governing body, is so heavily populated as to make such hunting dangerous” (§ 15.2-1113.1. Prohibiting hunting in certain areas (virginia.gov))) and the City of Chesapeake has an existing Ordinance that makes it “unlawful to discharge any firearm, …l from or across any land or water in the northern part of the city”, including for hunting, with very limited exceptions that apply to no property in this community. But we are being told that there are legal opinions that prevent the City from enforcing this Ordinance on State waters. This ambiguity of the law has allowed a hunter to construct this duck blind in the middle of the river, in a literal loophole of existing regulations. In November, this ambiguity has also encouraged others to discharge weapons on other parts of the river and we understand that at least two summonses were issued for trespass to these wayward hunters as they shoot within 150 yards of homes or pursue waterfowl onto private property. At Friends of Indian River meeting in November, dozens of residents came to the meeting and the overwhelming majority opposed hunting on the Indian River. Residents and visitors enjoy recreational boating, canoeing, kayaking, and fishing on the river; they should not have to worry about floating into the gun range of camouflaged hunters. Nor do residents wish to wake up to the discharge of shotguns at dawn or be disturbed while eating dinner. People buy waterfront properties here for peace and quiet. Residents and visitors enjoy watching the small flocks of ducks that come to our river in the winter. Additionally, with the construction of the new Blue Heron Landing Park and canoe/kayak launch, we expect more recreational paddling and fishing on the river that would be in conflict with discharge of weapons on the river. By State law or regulation, hunting on State waters is prohibited in certain areas of the State including state law passed in 2020 that prohibits hunting on Hunting Creek in Fairfax. Urban areas in Virginia Beach also prohibit hunting on State waters. We are asking for your support in giving our community in Chesapeake similar protection. I am writing in support of HB999 as a home owner living adjacent to the Indian River in Chesapeake. This is a highly urbanized area with most residential lots one-third of an acre or less in size. The Indian River area is in the northern part of Chesapeake adjacent to the city of Norfolk. Hunting on the land in the Indian River area has been prohibited by city ordinance for decades. Since the river itself is considered under state jurisdiction, this year hunters began to hunt waterfowl here, much to the dismay of the community and its residents. This presents a significant safety issue to all those who enjoy the river year round in their canoes, kayaks, and jet-skis and everyone who enjoys activities in their backyards adjacent to the river. Just this week my husband and I were awakened to the sound of loud gunfire early in the morning from hunters. Additionally, the city is currently constructing a canoe/kayak launching facility on the river which will encourage additional use of the river by people in small craft. We are not opposed to hunting in general, but this is not an appropriate place for this activity. For these reasons, I support this bill.

Recently a duck blind was allowed to be constructed in the river between Oaklette Drive, Walnut Avenue and Davis Avenue in Chesapeake on Indian River. The proximity of this to the residential areas has caused a significant impact to neighbors by allowing bird shot to come in close proximity to people’s homes, pets and children playing in yards. The considerable noise coupled with the danger of properties being affected by this should not have been allowed by the Dept of Game and Inland Fisheries. Common sense tells you placing a hunting location in between multiple residential areas is not a good decision and should not have been approved. This will affect the overall value of our homes along the waterfront and inability to sell our properties in the future. During duck hunting season, instead of me going outside on my deck and enjoying the peace of nature, I have to listen to continual gunshots that startle myself, my wife, neighbors, pets and other wildlife. This is a nuisance to all residents who appreciate living on this portion of Indian River and the quality of life here has diminished significantly because of this activity. I am asking to Support House Bill 999 to prevent hunting on Indian River. The City is currently in the process of constructing a boat ramp immediately upstream of this duck blind which will increase the amount of boating in this area therefore making it a safety issue for recreational boaters.

However, DCR's estimated measurements of the dam and pond minimally exceed the regulatory thresholds so it falls under the Dam Safety Act. For our low hazard dam, we must now expend significant dollars to comply. It should be exempt.
