This bill provides a legal process for an airport sponsor to address derelict or abandoned aircraft. When these situations occur, they often require a disproportionate amount of time and cash resources to address them in a manner that does not expose the airport to undue legal risk. Unlike motor vehicles and watercraft, there is no formal process to address these situations for aircraft in Virginia. This legislation helps ensure these situations are resolved transparently, expeditiously, and cost-effectively. This proposed legislation mirrors existing legislation from other states (e.g., Florida), and provides prescriptive measures for airport sponsors to follow to ensure all parties with a legal interest in the aircraft are duly notified and given sufficient opportunity to rectify the situation before an aircraft can be removed. This legislation helps Virginia's airports by supporting their ability to deliver quality aeronautical services, which includes using aircraft storage resources (e.g., hangars and tie-down areas) for their highest and best use. This legislation is supported by the Virginia Airport Operators Council (VAOC), a 501(c)6 organization that represents Virginia's 66 public-use airports. I am writing on behalf of the Virginia Airport Operators Council (VAOC) in support of HB446. The VAOC represents the interest of Virginia’s 66 public-use airports. These airports are critical economic gateways to our state, providing convenient, safe, secure, and beneficial access to the largest of our cities and the smallest of our communities. HB446 adequately addresses the needs of airport operators looking to address abandoned or derelict aircraft at their airfields. While abandoned or derelict aircraft is not necessarily a prolific or overly visible problem, there are more than a handful of airports across Virginia that are currently grappling with the proper and legal ways to address such a case at their airport. Existing state law prescribes established procedures to address abandoned cars and boats, however, there is not presently a clear procedure in place for aircraft. HB446 addresses that and provides for a transparent, precise, and codified procedure for airport operators to follow. HB446 provides for adequate research, and notification and establishes a clear process to follow in these circumstances, reducing legal costs, delays, and other overhead costs for the airport. HB446 establishes a fair process to be followed in these unique and special circumstances. The VAOC supports this legislation and we encourage its passage.

RE: HB793 – Speed Limit Reductions – Local Authority Committee on Transportation Members, The Town of Middleburg requests that you support House Bill 793 (HB793) that is currently in the House Committee on Transportation. This bill gives any local governing body the authority to reduce speed limits in a business district or residence district and would be important to the Town of Middleburg for enhancing safety in our historic downtown. HB793 clarifies language approved last year that gave this authority to localities. Since that time, VDOT has taken the position that only localities that maintain their own roadways were given the authority to reduce speed limits. While the Town has disagreed with VDOT’s position, we have also been unsuccessful in obtaining an adequate response to our request to reduce speed limits in Town. HB793 would give Middleburg the authority to make this determination based on our particular needs and community preferences. As you may know, Middleburg is historic and has a thriving downtown business district. We have a significant number of visitors, business owners, and residents that walk through down and cross Route 50 on a daily basis. Our particular needs may not always fit the VDOT standard model that is used across the Commonwealth. For the safety of our pedestrians and drivers, we believe the opportunity to reduce speed limits will reduce accidents, prevent serious injuries (and even death), and ensure enjoyment of our Town roadways for years to come. It is difficult enough to keep the speed of a motor vehicle down to 25 m.p.h., and in my experience, reducing the speed limit further will not increase compliance or reduce the operating speed of most motorists. Jurisdictions should be more proactive in enforcing the limits they have established.

I am a resident of Dunn Loring and oppose any and all efforts to establish or place speed cameras outside of school zones. These cameras do nothing to stop speeders, and are almost exclusively used to impose onerous fines on those that cannot afford them. Similarly, towns setting speed limits below 25mph has been historically used as a tool to selectively enforce rules with the effect of disproportionately affecting minorities. If speed is an issue, road design is the solution. Narrower lanes, hard bike lanes, and more traffic lights are the solution, not a money grab by way of automated fines administered by a third party in the private sector. I am an active voter and will actively oppose anyone voting for regulations that allow for automated traffic enforcement.

I do not support this bill. Regardless of personal income, if you utilize a toll road, you should pay the toll. There are alternate non-toll routes should someone choose to avoid a toll. This bill is a slippery slope: at what point do you determine someone should be given special favor? If a person doesn't have to pay a toll, why should they have to pay for their own food, clothing, phone, etc.? It's a recipe for personal degradation and community resentment cloaked in good intensions. Individuals who are struggling should seek help via private charity or church versus the government getting further entrenched in handouts.
