The League of Women Voters of Virginia supports SJ 223. We understand that democracy is most representative when everyone has a voice, and thus voting should be protected in our constitution. Voting is an important civic duty and an important way to participate in how communities are represented through those we elect and the laws that are passed. Voting is a critical way to engage in and rejoin society for those who have served their time. At present, it is estimated that 400,000 eligible people are still disenfranchised in Virginia, and this disproportionately affects minority and lower income Virginians. Fully restoring returning citizen’s voting rights reduces recidivism by 18%. Most returning citizens have jobs and pay taxes and may be a neighbor or someone you know. Currently, 12 states in the union already have automatic restoration. Please do not continue to punish people for life. Everyone deserves a second chance, and if this resolution passes, the Voters of Virginia would have an opportunity to voice their support or opposition at the ballot. We urge the Subcommittee to vote in favor of SJ223.
Please vote to report SJ 223. This amendment will automatically restore voting rights to people convicted of felonies upon release from incarceration. Currently, Virginia is one of only two states that require all people convicted of a felony to petition the governor, regardless of the crime committed.
The Virginia NAACP supports SJ274 and SJ223.
I support SJ223 to end the unjust disenfranchisment of far too many Virginians. Restoration of voting rights on release from incarceration is the common rule in the rest of the United States, but the Commonwealth of Virginia clings to a constitutional provision rooted in discrimination. It is shameful. SJ223 would also end the disenfranchisment of persons adjudicated incompetent to manage their affairs, many of whom have an interest in voting. I know from experience with my own mother that ability to balance a checkbook is not a measure of the validity of political opinions. Please start SJ223 on the long road to amending Virginia's constitution.

Death survivors left out of the property tax waiver that is afforded to line of duty survivors for first responders and to 100% disabled veterans snd their survivors. Their sacrifice was no less and their loss of income to their families was immediate.. Please pass SJ231 out of committee and to the floor for a vote to correct this oversight . Thank you.

I am Colonel Monti Zimmerman, US Army retired. I am the Vice Chair of the Joint Leadership Council for Veteran Service Organizations. SJ 231 is our number one priority for this legislative session. Last year, you passed a voluntary law that allowed this provision to be implemented at local level. As of now, only two counties, Fairfax with the largest combined population of spouses of killed in action (KIA) (by enemy) and surviving spouses of those who died on active duty provided the benefit to the balance of the 35 surviving spouses not in the KIA category. The total combined population in all Virginia tax jurisdictions is 211. The Department of Defense treats the two categories the same for statistical purposes as they are paid the same. This constitutional amendment will treat this group the same as 100% disabled veterans and the surviving spouses of the 100% disabled veterans. Please help us to help the surviving spouses who have lost their spouse and all that that spouse could have done to help them. Included is the list of surviving spouses that are either KIA or died on active duty. Thank you for your support!

I had the pleasure of visiting the GA throughout the session as a member of the VDVS-JLC and visited many offices to highlight & support several Veterans legislative initiatives. I ask you to reform the Virginia state law, to provide Tax Relief for Surviving Spouse of a Member of the Armed Forces “Killed in Action” through a Virginia Constitutional Amendment to include died in the “Line of Duty” in the section that addresses surviving spouses of members of the armed forces. This will equalize the benefit with the other categories of surviving spouses of those killed in action (by enemy) and 100% Disabled Veterans, rated Permanent and Total by the Veterans Administration, that are currently eligible to receive the property tax relief. I ask you to move SJ231 out of this committee, thru the House & ultimately place it on the Governor’s desk for signature. Thank You again for the opportunity to address this committee.
My husband served 14 years in the Marine Corps, during that time, He served in Iraq and was deployed in many locations throughout the world while paying VA taxes. He died in the line of duty and I returned to his hometown to raise our family. Yet our Constitution only allows KIA spouses and disabled service members and their spouses a pass at property tax, while I am excluded. I hope you will support the sacrifice of Virginia military families by voting in favor of SJ231 which will provide the same tax relief to ALL surviving spouses of active-duty military who lost their lives in the line of duty

Hello! My name is Yasin Wade, and I am a resident of the Hunters Mill district. I am the widow of Navy LT Daniel Wade who died in March 2015. I am also the mother of 3 boys, Daniel, Jaden & Micah. I am here today asking for a more inclusive tax waiver for Surviving Spouses of Military Service Members to also include “Died in the Line of -Duty.” I am here today to ask that the exemption be extended to cover the surviving spouses of military services because the military doesn’t distinguish a difference in benefits between KIA and Died In the Line of Duty. We know grief is grief and loss is loss. I am here today asking for your support of the SJ231. My husband Daniel was a prior-enlisted Naval Lieutenant. Daniel served for 10 years as a Submariner, earned the rank of Chief Petty Officer and, then later earned his rank as a Surface Warfare Officer. During his 16-year Naval career, he was awarded the Navy and Marine Corps Medal (Highest non-combat decorations award for heroism). The impact of the loss of my late husband is the same as any other military widow. With Daniel gone, I am trying to be both Mom and Dad. Raising children is hard. But raising grieving children is even more difficult. I am the chauffeur that drives three kids to three different soccer games and practices during the week. I am the chef. I am the coach of my kiddos basketball team. I am the keeper of memories, as the years' pass, it becomes harder to remember what life was like when you were only 4, 6, and 8. I am here to honor my husband Daniel because he also paid the ultimate sacrifice and, his service should be honored. I am asking the Virginia State Senate to support expanding tax relief for surviving spouses of military service members (SJ231).
Please support the expansion of the current tax exemption for real property available to spouses of soldiers killed in action to the surviving spouses of those who died in the line of duty. Not all service members who lose their lives in service to this country are killed on the battlefield. Some die from exposure to toxins or illnesses contracted while serving in contingency operations. My sweet husband is one of those. Scott first enlisted in the Marines in 1983 and then joined the Air National Guard for a total of 37 years of service, during which he was deployed multiple times. On his last active-duty deployment before his planned retirement, Scott was hospitalized in Jordan with a mysterious illness. Upon acquiring this illness, he developed a constellation of debilitating symptoms, which required 190 doctor’s appointments and four hospitalizations over the next 32 months. His pain was continuous and unrelenting and left him unable to resume employment or any normal activity level. His health declined steadily until his death on 03/23/2023. Military members and survivors pay an unimaginable price for their service and sacrifice. The pain of losing a spouse is indescribable. It is profoundly disorienting, traumatizing, and heartbreaking. Scott's suffering and sacrifice are no less worthy of recognition than they would be if he were killed in action. In essence, he was killed from action in Operation Inherent Resolve after suffering for 32 months from the illness acquired while deployed. This constitutional amendment is crucial to ensuring that the sacrifices of all who died in the line of duty are recognized.

My husband didn't serve 18 years in the United States Army to protect your freedom to discriminate against me because his line of duty death wasn't glamorous enough for The Hurt Locker or Restrepo. Why does our constitution NOT honor all those who died in the line of duty, but only those that make front page news? All service members put their lives on the line the day they sign up. The lucky ones retire in one piece. Disabled service members and their spouses earn a pass on real estate taxes, as they take home at least one full pension, and this pass continues for the surviving spouse. But surviving spouses of those WHO DIDN'T COME HOME, and are now surviving on a partial pension, get divided into "worthy" (KIA) or "unworthy" (non-KIA) recipients of the real estate pass? This unfairness is an insult to my late husband's patriotic fulfillment of his willingness to die for your freedom, whether his unit was under enemy fire or not.

I ask you to ignore the subcommittee and take this bill up for a vote of the full committee. Moreover, I ask that you report it out and let the House of Delegates vote as the first step toward letting Virginia voters have their say. You do not need to be a supporter of any particular position on marriage in order to support giving voters the final say on the question.
The League of women Voters of Virginia supports SJ 242. The League supports repealing the constitutional provision defining marriage as only a union between one man and one woman, and we support all marriages being treated equally under the law regardless of the sex or gender of the parties to the marriage. The League also hopes the General Assembly will consider that the civil status of marriage is already clearly distinguished from the religious institution of marriage and that religious rights will be preserved without additional language.
I believe SJ242 should pass because Virginia Is For Lovers, and that should include same-sex couples too. As a child my family moved to Toronto, Canada and it has long been one of my dreams to settle into NoVA after growing up away from my birthplace. One sticking point for me has been equality. Growing up in Toronto I have met people with varying opinions on same-sex marriage. However, reasonable people recognize that personal opinion should not change law. Fairness and due process should change law. Following due process in this matter would be to follow the law of the greater land, Obergefell v. Hodges 576 U.S. 644, as was passed federally in 2015. The United States of America is “The Land of The Free and The Home of The Brave”. I do not see how we as Virginian’s and American’s can purport to uphold the standards of Free and Brave or even The Pledge of Allegiance without giving same-sex couples the same chances at the American dream by enshrining their rights in our Constitution. We are meant to be Indivisible, while upholding Liberty and Justice for ALL. I hope to return to Virginia someday soon, and when I do I hope all friends, family, and neighbours will feel safe, happy, and welcomed by our Virginian hospitality. After all, Virginia Is For Lovers!
Please vote to report SJ 242, which repeals the same-sex prohibition in the Virginia Constitution. This amendment aligns the Virginia Constitution with the June 26, 2015 ruling by the Supreme Court that same-sex marriage is a fundamental constitutional right guaranteed under the 14th Amendment of the United States Constitution. This action struck down all state bans on same-sex marriage and legalized it in all fifty states.
I support SJ242. If passed this year, and again in 2024, and then by the voters, it will remove a stain of discrimination on our state constitution. Moreover, it will gladden the many Virginians who are now legally married because of the Supreme Court's Obergefell Decision, the many more Virginians who hope to marry one day, their family and friends who care about them, and all the other Virginians who believe bigotry has no place in our state constitution. All these Virginia voters deserve the opportunity to express their values at the polls. As we have seen since the 2015 Obergefell Decision, no clergy have had to do anything that violated their beliefs but, to the contrary, the many affirming churches and clergy have been empowered to perform legal marriages.
