Dear Del. Austin and House Transportation Committee Members: This letter is being submitted to express our concern with HB 1772. Founded in 1924, the AMA is the premier advocate of the motorcycling community. We represent the interests of millions of on- and off-highway motorcyclists and 6,000 members in Virginia. Our mission is to promote the motorcycle lifestyle and protect the future of motorcycling. The AMA believes that HB 1772 unjustly targets motorcycle riders as similar penalties, including impounding and disposition do not apply to other user groups. While we do not condone the usage of off-road motorcycles on public streets, this bill will not address the root cause of illegal riding activities, but instead will only serve to single out a user group. I have trouble understanding why there is any restriction for companies to do business in Virginia, a state which is business-friendly, once they have been approved by the state. Access to showrooms, and service departments is critical to making clean energy vehicles available to consumers across the commonwealth. Prohibition of such growth is tantamount to restraint of trade and antithetical to a free market. Why should one manufacturer that only manufactures electric vehicles be singled out from the other manufacturers who are now selling electric vehicles from their gas engine dealerships? Please keep HB2468 moving forward. This legislation cuts red tape for motor vehicle manufacturers to open and operate additional motor vehicle dealerships when the state has already determined that the establishment of those dealerships are in the public interest. Going through additional administrative hearings is expensive and time consuming for both the manufacturer and the Commonwealth.

I write in support of HB2468. My wife and I have owned several Teslas and have had to travel to Tyson's Corner and Richmond for delivery and occasionally for service. The Tesla stores have provided service at a higher level than most independent car dealers and there is no reason they should not have more locations in Virginia.

Many of the new EV manufacturers are using the direct-to-consumer model. Once a manufacturer has gone through the approval process in the Commonwealth, and been approved, they should be able to open other locations without having to repeat the same process. Requiring the repetitive process is a duplication of cost, not just on the manufacturers' part, but also on the Commonwealth's part.

Under HB2468, a new manufacturer entering Virginia’s market would still need to go through a hearing and DMV ruling before it could open a dealership. However, Tesla has already gone through this hearing process multiple times, and the DMV has found it’s in the public interest for Tesla to sell directly to consumers. Tesla’s leading the way in the transition to sustainable transportation, so it’s critical that Tesla open stores quickly to meet public demand in Virginia. I respectfully request you vote YES on HB2468. Thank you.
