January 27, 2022 Testimony in Opposition to HB 586 House General Laws Subcommittee #2 Dear Chairman Wampler and other committee members, My name is Isabel McLain, and I am the Research and Policy Analyst at Housing Opportunities Made Equal. Our mission is to ensure equal access to housing for all Virginians. My organization opposes HB 586 because it would discourage legitimate reasonable accommodation requests related to assistance animals. The bill threatens criminal penalties in cases where a request does not meet the standards proposed by this bill. This unnecessary criminalization is unprecedented in Virginia Fair Housing Law and it is dangerous. It will have a chilling effect on people who truly need to live with an assistance animal but are unsure if they qualify to do so. It is important to note that assistant animals are frequently used to support individuals coping with anxiety disorders and other mental health challenges, who would feel the stress of possible criminalization acutely. We believe that a denial of reasonable accommodation is punishment enough if the need is misrepresented. Additionally, there are already mechanisms in place to prevent false verifications, and providers are already governed by their own healthcare regulations to offer genuine documentation of disability. In addition to creating barriers for disabled Virginians, the criminal penalties created in this bill would undermine the substantial equivalency between our state and federal fair housing protections, jeopardizing state funding. Two other changes in this bill would also threaten equivalency. HUD has made it clear that reasonable accommodation requests do not need to be made in writing and do not need to come from a current care provider, both of which would be required under this bill. In conclusion, I ask you to vote against HB 586 for three reasons: it is unnecessary in preventing fraud; it threatens substantial equivalency; and it will greatly increase barriers for residents seeking rightful accommodations. The city has chosen ONE as a gaming host. This bill is identical to Morrissey's SB203 which puts limits on a casino referendum in Richmond for five years. We in the city of Richmond feels as Mr. Morrissey have committed MUTINY on us. We see this bill (HB-1134) only as a designed to remove Richmond city from becoming a host city, which in the end becomes Richmond being remove indefinite. PLEASE VOTE NO to HB-1134.
