This Bill 1. Does NOT curb youth acess to vapor products. 2. Does NOT regulate the retail sale of tobacco and nicotine vapor products. 3. Does NOT address the barriers of the information transfer between the FDA and the Office of Attorney General (OAG). 4. State agencies cannot verify that a PMTA application is still pending or not due to commerical data and privacy concerns. Therefore, creating great confusion for consumers and business owners. 5. Does serve BIG TOBACCO and will drive adults back to smoking cigarettes. 6. Does create a wasteful spend of taxpayer money by creating a confusion, duplicative registry system which has already been overturned in three states with similar laws. 7. I DO SUPPORT HB 790 and SB 582. Those bills ACTUALLY regulate the retail sale of Vape and tobacco products and will keep these products out of the hands of kids at the time of sale. Parents, Grandparents, Legal Guardians, Sister/Brothers, Cousins are the ones that need to be responsbile and canvas their children to educate and prevent these products from entering their hands/bodies. The adults of the state need to STOP purchasing for under 21+. The manufactuers of E-liquid had to pay between $250,000 to $1,000,000 dollars for their Pre-Market Tobacco Authorization (PMTA) submission and since 2020 have NOT received (1) approval letter from the FDA. Their Market Denial Orders (MDO's) had NO reason for their denial. The ONLY approval and/or reviews have been for BIG TOBACCO companies; ALTRIA, R.J. REYNOLDS, and PHILLIP MORRIS. Other states (ILLINOIS, NEW YORK, MARYLAND, MICHIGAN, MASSACHUSETTS, MONTANA, OREGON and WASHINGTON) has made E-liquid retail selling products require a "registered products" laws; just like HB 1069, HB 1509 and THIS BILL has had their vape shops in that state close their doors indefinetly due to NOT being able to meet the rules and regulations. Financial Analysts NEED to be researching how much revenue was lost in these states to include the unemployment rate due to loss of jobs and citizens moving out of the state. In FY 2023 the state of Virginia received $57.9 BILLION dollars in tax revenue from the Other Tobacco Products (OTP). The taxation department has NOT released information regarding how much of that $57.9 Billion is from Vape Products ONLY! Thank you for taking the time to READ my comment.
