I realize that in a time when social injustice and reparation talk is in the wind, the political fallout from failure to pass such a bill can be difficult. However, the generous distribution of 2,400 acres to an extended family unit arising from one single individual should be dismissed without further consideration. If this former "Indian" land is to be transferred, the more reasonable solution would be to return the land to its original and rightful treaty stewards, the Pamunkey Indian Tribe. See attachment for supporting documentation.

Sandy Point State Forrest was purchased by the Nature Conservancy using Federal Forrest Legacy Funds and the property was transferred to the Department of Forestry (DOF) beginning in 2003 with significant deeded restrictions. If the property is transferred, DOF must either repay the funds to the U.S. Forrest Service at current fair market value and/or replace the property with a like or greater conservation value property. The fiscal impact statement fails to take this into account. Attached is the deed for the first parcel that provides evidence of this requirement. Subsequent parcels transferred in 2005 contain the same requirement. If the committee is to consider this bill favorably, it should be referred to the Appropriations Committee to address this very important issue.
